Choosing your divorce attorney-Part 2

In a previous post, we took a look at some of the steps involved in the selection of a divorce attorney. We likened this process to matchmaking of a sort. We’ll continue this analogy at the point when you are about to embark on your first meeting with a potential divorce attorney.

When you sit down for a consultation, there are questions you may have that were not answered by a website or other source. Some questions we believe are worth asking of your prospective counselor might include:

 

 

  • length of time in family law/divorce specialty/practice
  • how many cases go to settlement versus going to court?
  • are you receptive to settlement at every stage? what is your typical strategy?
  • what is your retainer/when and what are charges for your services?
  • do you handle the case yourself, or is a team assigned as well?
  • what is your success rate with cases taken over from another attorney?

After meeting with an attorney, ask yourself: what is your impression of how the two of you related? Who did the most talking? The most listening? This is something you should devote serious thought to, because you will be spending considerable time, if not money, with your attorney, discussing serious personal, emotional, and financial issues.

Your preferences are your preferences, and in this all-important decision, if you have special criteria, be sure your candidate meets them. Just a few:

  • Are you more comfortable working with an attorney of the same gender as yourself?
  • Do you have unique or specific financial considerations?
  • Are there personal, health, geographical restrictions that will affect your selection?
  • Do you want requent contact regarding your case?
